Earnie Application Terms of Use

This User Agreement (hereinafter — the "Agreement") governs the access to and use of the Earnie application (hereinafter — the "Application") and is concluded between the Administrator and the User.

1. General Provisions

1.1. Administrator — Nikita Konev, a citizen of Israel.
1.2. User — an adult individual using the Application.
1.3. Application — a digital product available in Telegram Mini App, App Store, and Google Play.
1.4. API Integration — the voluntary connection by the User of their account on a third-party platform (e.g., Bybit) via a secure interface.
1.5. AI — a software algorithm that provides trading signals and recommendations within the Application.

2. Nature of the Application and Disclaimer of Warranties

2.1. The Application provides the User with access to signal strategies generated using artificial intelligence (AI).
2.2. All provided materials, signals, and forecasts are for informational and educational purposes only and are not investment advice.
2.3. The Application is provided on an "as is" basis. Results, profitability, and success are not guaranteed.
2.4. The User acknowledges and accepts that any trading decisions are made at their own risk and under their sole responsibility.

3. Registration, Account, and Account Management

3.1. To access the Application's functions, the User authorizes via Telegram, App Store, Google Play, or social networks.
3.2. The User agrees to: - Provide accurate registration data; - Ensure the security of their account; - Not transfer access to third parties.
3.3. The User is fully responsible for all actions performed through their account.
3.4. The User has the right to delete their account via the Application interface or by contacting support.
3.5. Account deletion may be irreversible and entails the deletion of all user information, except for data subject to storage by law.

4. API and Exchange Connection

4.1. The User has the right to connect their exchange account (e.g., Bybit) via API. This is done voluntarily.
4.2. The Application does not gain access to manage funds. The opening and closing of trades occur only with permission via the API within the limits set by the User themselves.
4.3. The User bears exclusive responsibility for the selection of API settings, limits, and parameters.

5. Subscription and Payments

5.1. Access to the main functions of the Application is provided by subscription.
5.2. Prices, rates, terms, and content are available in the application and on the website.
5.3. Refunds for an activated subscription are not provided, except as expressly provided by law or a separate offer.
5.4. The User may cancel subscription auto-renewal at any time before the next billing date.

6. Intellectual Property

6.1. All rights to the Application, including AI strategies, design, code, and interface, belong to the Administrator.
6.2. Any copying, distribution, or use of content beyond personal, non-commercial use is prohibited.

7. Blocking for Improper Conduct

7.1. The Administrator has the right to suspend or block the User's access to the Application without prior notice in the following cases: - Detection of attempts to hack, interfere with the code or API; - Use of the account for commercial or improper purposes; - Violation of the terms of this Agreement, including provision of inaccurate data; - Violation of legal norms or platform requirements (Telegram, App Store, Google Play).
7.2. Blocking may be temporary or permanent at the discretion of the Administrator.

8. Limitation of Liability

8.1. The Administrator is not liable for: - Losses incurred as a result of using or interpreting signals; - Technical failures, interruptions, or errors in the API operation; - Decisions made by the User based on AI signals; - Expected but not achieved results.
8.2. The maximum liability of the Administrator is limited to the amount of the paid subscription for the last payment period.

9. Termination

9.1. The User has the right to stop using the Application at any time.
9.2. The Administrator may restrict access without giving reasons in case of violation of the terms.

10. Privacy and Personal Data Processing

10.1. All terms of data processing are defined in the Privacy Policy.
10.2. By accepting the Agreement, the User agrees to the terms of processing and transfer of personal data, including technical data and Telegram ID.
10.3. Data is not transferred to third parties, except as provided by law or the necessity to perform the contract (e.g., integration with Bybit via API).

11. Changes to Terms

11.1. The Administrator has the right to make changes to the Agreement at any time. The current version is published on the website and in the Application.
11.2. Continued use of the Application after the publication of changes means the User's acceptance of the new version.

12. Governing Law and Dispute Resolution

12.1. The Agreement is governed by the laws of Israel and, for Russian Users, taking into account the requirements of Federal Law No. 152-FZ.
12.2. Disputes shall be resolved through negotiations. If this is not possible, they shall be settled in court at the place of registration of the Administrator.
